Illustrative Case Results

Approximately, over one thousand (1,000) DUI cases dismissed without the need for trial – cases varied in the fact scenarios but many had breath test results in excess of 0.13 and 0.14 – many were in the high teens and several were over 0.20. Following are the results of some of our cases.

  • 1. Client was stopped for weaving across the center line twice – failed field sobriety tests –
    had a half empty bottle of Brandi in the car - blew a 0.14 on the Draeger breath test
    machine – Jury trial resulted in a NOT GUILTY verdict
  • 2. Client left the scene of an accident – was stopped shortly thereafter – stumbled getting
    out of car and had to “hold on to car for balance” – failed field sobriety tests – refused breath test – Jury trial resulted in a NOT GUILTY verdict
    3. Client was stopped for weaving and failed field sobriety tests – had a half empty bottle of whiskey in the car – refused breath test – Jury trial resulted in a NOT GUILTY verdict
  • 4. Client weaved across center line and had a head on car crash – blew a 0.10 on the Draeger breath test machine – Officer didn't do field sobriety test due to inability of defendant to maintain balance while standing/walking – Jury trial resulted in a hung jury (no verdict)
  • 5. Client arrested and charged with DUI – Blew 0.18 on Draeger breath test machine – Case dismissed without trial
  • 6. Client blew a 0.31 on the Intoxilizer 5000 breath test machine - DUI was dismissed – client plead guilty to reckless driving
