This section of our website has been provided by the Law Office of Russell W. Crumbley as a courtesy for those people who don't feel like hiring a lawyer will make economic sense but could still use a little help.

The forms included herein were copied from the District Court Clerk of Madison County. However, they will not be sufficient to file with the clerk if you are proceeding with a suit. The clerk's copies have multiple carbon copies (for multiple parties to receive copies) and you will need to use their actual forms. The forms on this website are simply provided for you to see what is involved in a small claims suit.

If you elect to proceed with such a suit you can use these forms to know exactly what you will need prior to going to the courthouse. Fill them out at home and you will make one trip instead of two - then your day (and your experience) will be much nicer.

There is a filing fee required and you can confirm you have everything you need prior to filing by calling the District Court Clerk at 532-3373.

A couple of note: If you are filing the suit, you are the Plaintiff. The party you are suing is the Defendant.

When your day for court arrives - remain calm. The judge will likely have both parties approach the bench and state their version of the facts. Each party can ask the other questions and then you will be finished. The judge will either rule on the spot or, many times, they will “take the matter under advisement” and make a ruling in the next few days.
